The Investment Advisors Act of 1940 was created to monitor and regulate the activities of investment advisors which is now regulated by the SEC (Securities and Exchange Commissions). The advisor, as a fiduciary, owes the client a duty of loyalty, which means they must act in the best interest of the client.
